فذلك لأن أصحاب مالك يسمون هذه سنناً، والسنة عندهم قد تكون واجبة إذا تركها أعاد،
This is because Malik's followers call these practices Sunnah, and a Sunnah in their view can be obligatory; if it is left, it must be repeated.
وَالسُّنَّةُ — and a Sunnah. The wa- here starts a new clause ('and the Sunnah...') rather than joining two list items, and the 'the' attached after it makes the noun definite and generic, 'the Sunnah as a category'. This definite noun is the subject the rest of the clause will describe.

Some may think that Sunnah for them is only what can be left; but it is not so.
السُّنَّةَ — the Sunnah. The 'the' makes this noun definite and generic, 'the Sunnah as such', and it is the topic governed by 'anna' before it, hence its accusative ending. It is the thing the supposed opinion is about.
